No.15544 of whereunder directions/observations were given/made that in case the representation stating details of unpaid claims is filed by the by the petitioner within a period of four weeks along with the certified copy of the present order as also the copy of

Patna High Court MJC No.6722 of 2012 dt.10-02-2015 2/3 the relevant documents, if any, in support of the claim, the above respondent shall consider the claims of the petitioner as raised in the representation in accordance with law expeditiously, preferably within a period of four months on receipt of such representation so that the grievances of the petitioner could be settled without delay and the admitted dues could also be paid along with interest permissible under the rules.

Learned AC to GA-XII, appearing on behalf of the State, submits that in the light of the order dated 20.09.2010 under contempt, the representation of the petitioner has been disposed of by Opposite Party No.3, the Director, Secondary Education, Bihar, Patna, on 25.11.2014 and a copy of the same has been sent to the petitioner vide Memo No.479(Vidhi) dated 25.11.2014, which would appear from Annexure-'E' to the show cause filed on behalf of the Opposite Party No.3, the Director, Secondary Education, Bihar, Patna, and later on, regarding the claim of the petitioner, the Opposite Party No.6, the District Education Officer, Bettiah, West Champaran, also passed the order dated 06.12.2014, rejecting the claim of the petitioner which was also communicated to the petitioner vide Memo No.989 dated 06.12.2014 as also to the concerned authorities, which would appear from Annexure-'C' to the 2nd supplementary show cause filed on behalf of the Opposite Party No.6, , the District Education Officer,

Since the order under contempt has already been complied with by the concerned opposite parties by deciding the representation filed by the petitioner, no further action is required to be taken against the concerned opposite parties. Accordingly, this contempt application stands disposed of. However, if the petitioner is aggrieved by the same, he would be at liberty to take legal recourse in accordance with law before the concerned authority for redressal of his grievance.
