Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is apprehending his arrest in connection with Tarari P. S. Case No. 200 of 2020 registered for the offences punishable under Sections 406, 420, 504 and 506 of the Indian Penal Code.

As per the prosecution case, the informant was working as daily wage worker in the house of the petitioner. In the year 2015, the petitioner took the informant to Simdega, Jharkhand on the pretext of getting him better job there and took

After sometime, the informant received a demand notice of Rs. 35,14,120/- from the office of Certificate Officer, Simdega bearing C.C. Case No. 10/16. When informant went to Simdega, Jharkhand to enquire about the said notice, he came to know that three licences of liquor shop was allotted to his name and tax is dues against him. It is further alleged that when the informant went to meet the petitioner for knowing such facts, the petitioner threatened him.

Learned counsel for the petitioner has submitted that the petitioner has falsely been implicated in this case. No such occurrence as alleged has ever taken place. The alleged occurrence took place at Simdega, Jharkhand but the F.I.R. has been lodged in Bhojpur, Ara, which is beyond jurisdiction. Learned counsel further submits that no case is made out against the petitioner. The petitioner has got no criminal antecedent as stated in para 3 of the bail petition.

Learned A.P.P. for the State has vehemently opposed the prayer of anticipatory bail petition of the petitioner. Considering the aforesaid facts and circumstances, let the above named petitioner, in the event of his arrest/surrender within a period of six weeks from today, be enlarged on bail on

Patna High Court CR. MISC. No.59283 of 2022(4) dt.07-02-2023 3/3 furnishing bail-bond of Rs. 20,000/- (Rupees twenty thousand) with two sureties of the like amount each to the satisfaction of the learned Court concerned, Bhojpur, Ara in connection with Tarari P. S. Case No. 200 of 2020, subject to conditions as laid down under section 438(2) of the Code of Criminal Procedure. The application stands allowed.
