2. The petitioner seeks bail in anticipation of his arrest in a case registered for the offences punishable under Sections 8, 20(b)(ii)(c), 22(c), 29 NDPS Act in connection with NDPS Case No.15 of 2023 arising out of Ratanpura P.S. Case No.14 of 2023.

3. The learned counsel for the petitioner submits that petitioner is a person with clean antecedent and the informant alleges that he received secret information that one Shambhu

No.67646 of 2024(2) dt.13-09-2024 2/3 Yadav and Ranjeet Mukhiya are going to smuggle huge quantity of narcotics into India from Nepal via Koshi river, accordingly, based on the said information a team was constituted and a check post was set up near Koshi river, further at around 10 PM the SSB officials noticed few persons, carrying something on their head and entering Indian border and on seen the SSB persons the accused started fleeing throwing their bag which they were carrying on their head, when they are asked to stop, however, three accused were apprehended namely, Ranjeet, Anil and Deo Chandra Sada (Petitioner), it is next alleged that altogether 8 white coloured large bags were recovered containing 238 Kg. of Ganja.

4. The learned counsel submits that petitioner has been falsely implicated in the instant case by the informant. It is also submitted that the main accused fled and the petitioner who was crossing the border along with Ranjeet and other empty handed were apprehended.

5. The learned Central Government Counsel submits that petitioner was apprehended from the spot along with two other accused and the recovery of narcotic is huge.

6. Considering the submissions made by the learned Central Government Counsel, the Court is not inclined to extend
