The petitioner has renewed his prayer for grant of regular bail in a case registered under section 392 of the Indian Penal Code.
As per the prosecution case, while the informant was coming on his motorcycle, he was stopped and on the point of country made katta he was dispossessed of the gold chain and and other articles mentioned in the FIR.
It is submitted by learned counsel for the petitioner that the earlier application for bail of the petitioner was rejected vide order dated 18.2.2022 (Annexure-1) passed in Cr. Misc. no. 40639 of 2021. It is further submitted that the FIR was
Patna High Court CR. MISC. No.61540 of 2022(2) dt.23-11-2022 2/2 registered against unknown. The name of the petitioner transpired in course of investigation. No incriminating article has been recovered from his possession. He is in custody since 1.12.2020 and chargesheet has been submitted in the case. . The application for bail is opposed by learned APP for the State who submits that the petitioner was identified by the informant in the T.I. parade.
Having heard learned counsel for the parties and taking into consideration the petitioner having remained in custody for more than 1 year 11 months since 1.12.2020, the petitioner is directed to be enlarged on bail in connection with Hajipur Town P.S. Case no. 645 of 2020 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Vaishali at Hajipur.
