Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 126(2), 115(2), 109, 74, 352, 351(2) and 3(5) of the Bharatiya Nyaya Sanhita.

Learned counsel for the petitioner submits that the petitioner is a person with clean antecedent and the informant alleges that petitioner along with other accused in a drunken condition at 8 p.m. called her husband, on which the informant replied that he was sleeping, thereafter the accused entered her house and acted inappropriately with her and molested her sister-in-law and when her husband came, the petitioner and Panchu assaulted him by brick causing injury on head.

The learned counsel for the petitioner submits that petitioner has been falsely implicated in the instant case by the informant. It is next submitted that from perusal of the allegation as alleged in the FIR, it would manifest that informant alleges that petitioner along with other accused came and called her husband from outside when she replied that he was sleeping, thereafter it is alleged that they entered the house and committed the occurrence. It is further submitted that had the petitioner any intention of committing any occurrence of acting inappropriately with the female members of the house, in that event he would not have called her husband, rather would have entered directly. It is also submitted petitioner and the informant are neighbours and are having disputes relating to land. It is next submitted that there is no injury report on record. 5.

Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount
