2. In this case, the petitioner is seeking regular bail in connection with NDPS Case No. 68 of 2023 arising out of Supaul P.S. Case No. 940 of 2023, registered for the offences punishable under Sections 21(b) of the NDPS Act.

3. As per allegation, 110 bottles, each containing 100 ml codeine syrup was recovered from the shop of the petitioner. The total weight of the recovered codeine syrup is 22 gm.

4. The learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. He has submitted further that the studio wherefrom the alleged contraband is said to have been recovered, does not belong to the petitioner. He has also submitted that the petitioner is not involved in any other case of similar nature and he is under

Patna High Court CR. MISC. No.65222 of 2024(2) dt.19-09-2024 2/2 custody since 26.12.2023.

Considering the above-mentioned facts and circumstances, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-IV, Supaul in connection with NDPS Case No. 68 of 2023 arising out of Supaul P.S. Case No. 940 of 2023, subject to the following conditions:- (i) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court. (ii) Before accepting the bail bond, the learned court below shall verify the criminal antecedent of the petitioner and if it is found that he is involved in any other case except the case under Section 498 (A) of the IPC which has been mentioned in paragraph 3 of the bail petition, his bail bond shall not be accepted.
