Admittedly, petitioner was neither caught on the spot nor anything was recovered from his conscious possession. So far as criminal antecedent of the petitioner is concerned, it has been mentioned at para 3 to this petition that the petitioner does not have any criminal antecedent but submission on behalf of the petitioner is that prior to institution of the present case, two cases were registered against the petitioner and when the aforesaid fact came to the notice of Parvikar of the petitioner, he filed supplementary affidavit before this court.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate,
