2. The petitioner seeks bail in connection with Sessions Trial No. 493 of 2023 arising out of Maharajganj P.S. case No. 110 of 2024 instituted for the offences under Sections 304(B), 201, 120B, 34 of the Indian Penal Code.

3. Earlier vide order dated 04.02.2025 passed in Cr. Misc. No. 74912 of 2024 by a coordinate Bench of this Court, the prayer for grant of bail to the petitioner was rejected with liberty to the petitioner to renew his prayer for grant of bail after examination of the informant.

4. Learned counsel for the petitioner submitted that

Patna High Court CR. MISC. No.62477 of 2025(2) dt.09-09-2025 2/3 vide order dated 04.02.2025 passed in Cr. Misc. No. 74912 of 2024 by a coordinate Bench of this Court, the prayer for grant of bail to the petitioner was rejected with liberty to the petitioner to renew his prayer for grant of bail after examination of the informant but the informant has not yet been examined and the petitioner has been languishing in jail since 16.04.2024. Learned counsel further submitted that there is no likelihood of examination of informant in near future and therefore, petitioner may be released on bail. It has been submitted on behalf of the petitioner that the petitioner has no criminal antecedent.

5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner.

6. Having considered the submissions made on behalf of the parties, this Court finds no fresh ground to reconsider the matter which has already been decided on merit by a coordinate Bench of this Court.

7. Accordingly, the prayer for grant of bail to the petitioner is, hereby, rejected.

8. Learned Trial Court is directed to expedite the trial.

9. However, liberty is granted to the petitioner to renew the prayer for grant of bail before the Trial Court if the informant is not examined within a period of one month from

10. The District Magistrate, Siwan and Superintendent of Police, Siwan are directed to ensure the presence of witnesses before the learned court below concerned for expeditious conclusion of trial.

11. Let a copy of the order be communicated to the District Magistrate, Siwan and the Superintendent of Police, Siwan.
