JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 03-07-2019 The petitioner has filed this writ petition for consideration of his case for appointment on regular pay scale instead of appointment as Assistant Teacher, Prathmik Vidyalaya on fixed remuneration.

The issue raised in the present writ petition is no more res integra. The Apex Court has occasion to decide the similar matter in the case of Mukesh & anr. Vs. The State of Bihar & Ors: (2017) 5 SCC 383.

In view of the above, the writ petition is disposed of with a direction to the respondents to take appropriate decision in the light of the judgment of the Apex Court in the case of
