JUSTICE MOHIT KUMAR SHAH ORAL ORDER 29-10-2018 On the last occasion, when the matter was taken up, nobody had appeared. Today also nobody has appeared to press the present writ petition. However, the learned counsel for the respondents- Insurance Company submits that the present writ petition is not maintainable against a private individual. In this regard, a Judgment rendered by a co-ordinate Bench of this Court dated 27.7.2016 passed in CWJC No. 10932 of 2016 has been produced by the learned counsel appearing for the respondent Insurance Company.
Having considered the submissions made by the learned counsel appearing for the respondents, it is held that the
Patna High Court CWJC No.1552 of 2018 (2) dt.29-10-2018 2 /2 present writ petition is not maintainable in its present form. Accordingly, the present writ petition is dismissed. However, liberty is granted to the petitioner to agitate his grievances before an appropriate forum of competent jurisdiction. (Mohit Kumar Shah, J) BTiwary/- U
