2. The petitioner has prayed for regular bail in a case registered for the offence punishable under Sections 80 and 3(5) of the B.N.S.
3. The case of prosecution, in short, is that, the daughter of the informant, namely, Ritu Kumari (deceased) was married with the petitioner in April, 2024. It is further alleged that Ritu Kumari (deceased) lived happily at her matrimonial home and after some time, all the accused persons including the petitioner started torturing her mentally and physically and killed her. When the informant reached the matrimonial home of her daughter, she found her daughter lying dead.
4. Learned counsel for the petitioner submits that the
Patna High Court CR. MISC. No.62567 of 2025(3) dt.28-11-2025 2/3 petitioner is innocent and has committed no offence. Learned counsel for the petitioner has submitted the petitioner neither demanded any dowry nor tortured the deceased. It has also been submitted that there is no antemortem injury except the mark of electrocution as mentioned in the post-mortem report. Moreover, the petitioner is languishing in judicial custody since 21.06.2025.
5. Learned APP appearing for the State has vehemently opposed the prayer of regular and submitted that the cause of death is due to Asphyxia and cardiac dysfunction caused by electrocution. It is further stated that from perusal of the post-mortem report, it is evident that the area of burnt skin in her hand in index finger, middle finger and in between both finger and all these injuries are black dry with pale base and raised margin with erythematous surface. It has also been submitted that the petitioner is having criminal antecedent of one case.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Sikraul P.S. Case No. 42 of 2025 on furnishing bail bond of
Patna High Court CR. MISC. No.62567 of 2025(3) dt.28-11-2025 3/3 Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Buxar/concerned Court below.
