It appears from the restoration application that the S.A.No.259/2009 was dismissed for non-compliance of the order dated 01.07.2010 passed by this Court. However, from the perusal of the records it appears that the S.A.No.259/2009 was restored by order dated 15.12.2010 passed in M.J.C.No.4757/2010.

In view of the aforesaid fact, this restoration application is clearly misconceived and is dismissed as such. (V. Nath, J) Nitesh/- U
