The petitioner has renewed his prayer for anticipatory bail in a case registered for offences punishable under Sections 419, 420, 465, 467, 468 and 471 of the Indian Penal Code. The prosecution case is that the petitioner in 2003 got himself employed as Shiksha Mitra (teacher) on honorarium basis claiming himself to be Rankesh Kumar, but subsequently in the year 2006 he got himself appointed as Nagar Shikshak claiming himself to be Rajesh Kumar.
It is submitted by learned counsel for the petitioner that in some of the educational certificates of the petitioner his name has been recorded as Rankesh Kumar and in the others as Rajesh Kumar. Moreover, recovery of honorarium paid to the petitioner has been ordered and a writ application being CWJC
Patna High Court Cr.Misc. No.54217 of 2017(3) dt.31-10-2018 2/2 No. 10666 of 2014 is pending before this Court. In the circumstances prayer for anticipatory bail has been renewed. Since no fresh ground has been made out, this Court is not inclined to revise the earlier order. However, keeping in view the fact that the engagement of the petitioner was only for eleven months in 2003 and subsequently, the petitioner has been appointed as Nagar Shikshak in 2006 coupled with the fact that recovery of honorarium has already been made, it is a case for consideration of prayer for regular bail of the petitioner by the learned Court below in case the petitioner surrenders within a period of six weeks before the learned CJM, Khagaria in connection with Khagaria Town P.S. Case No. 322 of 2014. With the aforesaid observation/direction, this application is disposed of.
