JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 07-03-2022 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Hussainganj P.S. Case No. 329 of 2019, registered for the offence punishable under Sections 302, 203, 120(B) and 34 of the Indian Penal Code. As per the FIR, elder son of informant solemnized inter caste marriage with the daughter of co-accused Shiv Prasad Rajbhar. A panchayati was convened, but the daughter of Shiv Prasad Rajbhar was not ready to go to her native home. Informants suspects that due to ill motive all the accused persons including petitioner committed murder of younger son of informant namely, Golu Kumar and threw his dead body in the pond.

It is submitted on behalf of petitioner that informant is not eye-witness of the occurrence and only on suspicion

Patna High Court CR. MISC. No.70444 of 2021(2) dt.07-03-2022 2/2 petitioner has been made accused in this case. Similarly situated co-accused have been granted anticipatory bail by this Court vide order dated 13.01.2022 passed in Cr. Misc. No. 6946 of 2021. Petitioner claims clean antecedent and he is in custody since 19.09.2021.

Considering the facts and circumstances of the case, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Siwan in connection with Hussainganj P.S. Case No. 329 of 2019.
