The petitioner seeks bail in Kotwali P.S. Case No. 132/2016, registered for the offences punishable under Sections 25(1-B)a, 26(i)(ii) and 35 of the Arms Act.

The police apprehended three persons namely, Suraj Tanti, Md. Naseem and Neelam Devi. Four country made pistol was recovered from the possession of the petitioner, two countrymade pistol was recovered from the possession of Neelam Devi and three country-made pistol was recovered from the possession of Md. Naseem.

It is submitted that the petitioner is in jail since 11.05.2016. The petitioner has already remained in jail for about eleven months and he has got no criminal antecedent as stated in

Patna High Court Cr.Misc. No.9439 of 2017 (2) dt.12-04-2017 para 3 of the bail petition. Neelam Devi has already been granted regular bail vide order dated 15.02.2017 passed in Cr. Misc. 2725/2017.

Considering the facts aforesaid and the fact that the petitioner has already remained in jail for eleven months without having any criminal antecedent, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of 5th Additional Sessions Judge, Munger in connection with Munger Mufassil P.S.
