This application for anticipatory bail arises out of Chausa P.S. Case No. 39 of 2019 for the offence punishable under Sections 379, 337, 338, 307, 504 and 506/34 of the Indian Penal Code and Section 27 of the Arms Act.

There is allegation against the persons named in the First Information Report that they have assembled near the house of the informant and were firing shots. It is further alleged that co-accused Awadhesh Yadav fired a show on the informant, which he missed, whereafter the accused persons, with an intent to kill him, dashed their motorcycle with the informant. Learned counsel appearing on behalf of the petitioners has submitted that certain dispute of civil nature

Patna High Court CR. MISC. No.56147 of 2019(2) dt.05-09-2019 2/2 between the parties is the reason behind the lodging of the criminal case and apparently no person has received any fire arm injury. He has also submitted that there is no specific allegation against the petitioners of any overt act. Considering the facts and circumstances, this application is allowed.

Let the petitioners above named, in the event of their arrest/surrender within six weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Udakishunganj, Madhepura, in Chausa P.S. Case No. 39 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioners shall present themselves before the Police/Court, as the case may be, as and when required and in the event of failure on their part to appear before the Court on two consecutive occasions, their bail bonds shall be liable to be cancelled.
