This application for anticipatory bail arises out of Nawada Complaint Case N0. 897 of 2018, disclosing offences under Sections 323,354,380,468 of the Indian Penal Code.

The petitioner is uncle of the husband of the complainant. His brother and other family members have also been made accused. It is alleged against the petitioner that he had attempted to outrage the modesty of the complainant. It is alleged against co-accused persons also of having entered into the complainant's house with bad intention.

Learned counsel appearing on behalf of the

Patna High Court CR. MISC. No.55771 of 2019(2) dt.03-09-2019 2/2 petitioner appears to be correct in his submission that the allegation in the complaint petition of having outraged the modesty is completely vague.

Consider the above submission, this application is allowed.

Let the petitioner above named in the event of his arrest/surrender within six weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate First Class, Nawada in Complaint Case No. 897 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioner shall present himself before the Police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
