The petitioner seeks bail in a case instituted for the offences under Sections 37(b)(c) of the Bihar Prohibition and Excise Act, 2016.

Allegation is that the petitioner is said to be in drunken state.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 12.07.2019 and has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is said to be in drunken state. There is no recovery of any liquor from the possession of the petitioner.

Considering the aforesaid facts and circumstances, it is directed that the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Additional Sessions Judge-cum-Special Judge, Araria in connection with Sadar Circle Excise case No.29 of 2019 corresponding to Special case No.882 of 2019.
