The petitioner seeks bail in Muffasil (Singhaul) P.S. Case No. 653 of 2020, registered for the offence punishable under Sections 307, 302 and other allied sections of the Indian Penal Code.

As per the prosecution case, all the FIR named accused persons including this petitioner assaulted the brother of informant by means of rod and Khanti causing his death. It is submitted on behalf of the petitioner that there is case and counter case. Present case is counter blast of Muffasil PS Case No. 652/2020 which was filed by co-accused Subodh Sah for murder of his wife. There is general and omnibus allegation of assault against all the FIR named accused persons

Patna High Court CR. MISC. No.70740 of 2021(2) dt.07-03-2022 2/2 and no specific overt act has been alleged against this petitioner. Similarly situated co-accused has been granted bail by this Court vide order dated 13.01.2022 passed in Cr. Misc. No. 49762 of 2021. Petitioner claims clean antecedent and he is in custody since 23.12.2020. Investigation is complete. Considering the facts and circumstances of the case, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District & Sessions Judge XIV, Begusarai in connection with Muffasil (Singhaul) P.S.
