JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 12-04-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks bail in connection with Special Case No. 41 of 2016, arising out of Buxar Town P.S. Case No. 322 of 2016, registered under Sections 223, 224 and 384/34 of the Indian Penal Code and Section 13(1) A/D (i) and (ii) of the Prevention of corruption Act.

The accusation is that a team in the leadership of S.I. Dharmendra Kumar raided the house of Bablu Choudhary, where several persons were playing gambling, but Rajendra Verma, who was apprehended on the spot was set free after receiving Rs. 1,50,000/- from him. The petitioner being the

Learned counsel for the petitioner submits that, in fact, the petitioner was engaged as a driver on the contract basis and he has been implicated in this case. Further submission is that petitioner has no criminal antecedent is in custody since 24.01.2017 and Chargesheet has been submitted against the petitioner.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Special Judge, Vigilance 1st, Patna in connection with Buxar Town P.S.
