2. It transpires to this Court vide order dated 06.10.2023 that petitioner seeks permission to file supplementary affidavit in this case about payment of 50% of the total calculated amount which has been directed to paid by the learned Sessions Judge, Patna to the opposite party no. 2.

3. It also transpires that vide order dated 03.11.2023, the petitioner was aware that he has to file affidavit showing that petitioner has paid 50% of the total calculated amount. It is due to this reason, the matter was adjourned.

4. Upon perusal of records, supplementary affidavit has been filed but payment has not been made. Counsel submits

Patna High Court CR. MISC. No.64170 of 2023(5) dt.09-02-2024 2/2 that petitioner has paid only Rs. 45,000/- till now.

5. Counsel for the State submits that petitioner may be directed to pay certain amount to the opposite party then only it may be restored.

6. In the light of the submissions made, this court directs the petitioner to pay Rs. 50,000/- more to the O.P.

7. Upon deposit of Rs. 50,000/- this Cr. Misc. No. 64170 of 2023 shall be restored subject to the matter that petitioner shall pay the aforesaid amount to the bank account no. of O.P.
