JUSTICE SANJAY PRIYA ORAL ORDER 29-06-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Rajpur P.S. Case No. 34 of 2017 instituted for the offence under Sections 272, 273 of the Indian Penal Code and Section 30(a) of Bihar Excise (Amendment) Act, 2016.

It has been submitted on behalf of the petitioner that he was merely passenger of the Pick-up van. He has no concern with the liquor which is alleged to have been recovered. As per written report, 6432 bottles, each containing 180 ml. has been recovered from the pick-up van. The driver of the van Awdhesh Choudhary managed to flee away. Petitioner is in custody since 2.3.2017.

It is mentioned in paragraph-3 of the bail petition that

Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J. 2nd-cum-Special Excise Court, Buxar, in connection with Rajpur P.S. Case No. 34 of 2017, subject to the condition that both the bailors will be the close relatives of the petitioner.
