2. The petitioners seek regular bail in connection with Khagaria P.S. Case No. 179 of 2025 for the offences registered under Section 30(a) of the Bihar Prohibition & Excise Act.

3. There is recovery of 341.100 litres of foreign liquor from a Mahindra Bolero Pick-up bearing Registration No. BR 34G 6788 in which petitioners were sitting.

4. Learned counsel for the petitioners submits that petitioners are innocent and have falsely been implicated in this case. It is submitted that nothing has been recovered from possession of petitioners. Petitioners have no concern either

Patna High Court CR. MISC. No.58530 of 2025(3) dt.09-10-2025 2/2 with the seized vehicle or with the liquor. They are only driver and co-driver of the vehicle. They had no knowledge about the seized liquor kept in the said vehicle. Petitioners have no criminal antecedent. They are in custody since 26.06.2025. Petitioners undertake to co-operate in the trial.

5. Learned counsel appearing on behalf of the State opposes the prayer for grant of bail to the petitioners.

Considering the submissions made on behalf of the parties, facts and circumstances of the case and period of custody, let the petitioners, named above, be enlarged on bail upon furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Exclusive Special Excise Judge II, Khagaria in connection with Khagaria Excise P.S. Case No. 179 of 2025.
