====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 16-05-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State.

Let the defect(s), if any, be removed within a period of four weeks after complete start of the physical Court. The petitioner seeks bail in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code read with Section 27 of the Arms Act.

Learned counsel for the petitioner submits that the petitioner is in custody since 14.02.2021, charge-sheet has been submitted and is a person with clean antecedent. The informant alleges that she along with her sisterin-law (Gotani) went to give food to their father-in-law then the named accused persons came and Chandu Yadav caught her father-in-law and Ravindra Prasad and Amit fired as a result of

Patna High Court CR. MISC. No.70442 of 2021(2) dt.16-05-2022 2/2 which he died. It is alleged that Pinki Devi in conspiracy with accused got her father-in-law killed.

Learned counsel for the petitioner submits that though the petitioner is named in the FIR but no specific allegation is alleged against him. Allegation of firing is against Ravindra Prasad and Amit. As far as Chandu Yadav is concerned, it is alleged that he had caught the deceased. It is, thus, submitted that petitioner at best was a member of the mob with no specific overt act.

Learned A.P.P. for the State vehemently opposes the prayer for regular bail of the petitioner.

Considering the fact that the petitioner is in custody since 14.02.2021, charge-sheet has been submitted and is a person with clean antecedent and is not the assailant, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Islampur P.S. Case No. 645 of 2020.
