JUSTICE SANJAY PRIYA ORAL ORDER 01-09-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks regular bail in Ram Nagar P. S. Case No. 299 of 2016 registered for the offence under Sections 21 (B) of N.D.P.S.Act, 1985.

It is alleged that on confidential information received by the police that the petitioner and other accused persons are selling the intoxicating substance ( Smack) in their fruit shop, the police party raided the fruit shop of petitioner and on search 116 puria of smack and 5 grams of smack wrapped in a plain paper were recovered from the possession of the petitioner and 46.5 mg and 109 grams

Patna High Court Cr.Misc. No.24216 of 2017 (4) dt.01-09-2017 2/2 recovered from the other accused persons. The informant prepared seizure list. A copy of seizure list was handed over to the petitioner.

Considering the specific allegation against the petitioner of possessing intoxicating substance, this Court is not inclined to grant bail to the petitioner and accordingly, the prayer for bail is rejected at this stage. The trial Court is directed to expedite the trial of the petitioner.
