JUSTICE SANJAY PRIYA ORAL ORDER 27-04-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Karagahar P.S. Case No. 190 of 2016 instituted for the offence under Sections 341, 323,326, 342, 324, 272, 307/34 of the Indian Penal Code and Section 27 of the Arms Act.
It has been submitted that occurrence is alleged to have taken place on 22.8.2016 and case has been registered on 7.9.2016 after delay of more than 15 days. It has further been submitted that there is land dispute between the parties. The petitioner is cousin father-in-law of the informant. There is admitted land dispute between the parties. The petitioner is in custody since 19.9.2016.
Case diary has been received.
Patna High Court Cr.Misc. No.1168 of 2017 (4) dt.27-04-2017 The injury report of the informant has been enclosed with the case diary wherein the doctor has found the injury caused by fire arms but the opinion has been kept reserved. In such circumstances, keeping in view that there is land dispute between the parties and the petitioner is in custody since 19.9.2016, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Sasaram at Rohtas, in connection with Karagahar P.S.
