JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 05-01-2022 Heard learned counsel for the petitioner and the State. The petitioner prays for grant of regular bail in a case registered for the offence punishable under sections 302/34 of the Indian Penal Code.

As per the prosecution case, four named accused persons including the petitioner assaulted mother of the informant with Daab causing her death.

Learned counsel for the petitioner submits that the though there is allegation of assault by Daab but the doctor conducting autopsy has not found any external injury on the dead body which belies the prosecution case. After investigation, the allegation was fond illogical and final form was submitted. Differing with the same, court below has taken cognizance of the offence under section 302 of the Indian Penal Code. Petitioner has claimed clean antecedent and he is in

Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge IX, Aurangabad in Sessions Trial No. 216 of 2021/90 of 2021.
