The present writ application has been filed for implementation of the order dated 05.08.2016, passed in Misc. Case No. 15 of 2015 by the House Controller, Bhagalpur Sadar. During pendency of the writ application, vide order dated 20.04.2018, passed by District Magistrate-cum-Appellate Authority, Bhagalpur, in House Controller Appeal No. 01 of 2017-18, the said order of the Housing Controller has been set aside.

After some argument, learned counsel for the petitioner seeks permission to withdraw the present writ

Patna High Court CWJC No.2387 of 2018(2) dt.06-09-2018 2/2 application with a liberty to file revision application before the Divisional Commissioner.

Permission is accorded.

Accordingly, the present writ application is dismissed as withdrawn with above mentioned liberty to the petitioner. In view of the subsequent development having taken place during the pendency of this writ application, the petitioner is permitted to prefer a revision application along with an application for condonation of delay within a period of three weeks from the date of receipt/production of a copy of this order.
