JUSTICE MOHIT KUMAR SHAH ORAL ORDER 19-06-2018 The petitioner by way of the present writ petition seeks a direction upon the respondents to implement the letter of the District Panchayati Raj Officer, Gaya dated 17.11.2009 whereby and whereunder the appointment of Saroj Kumar has been cancelled and it has been directed that a fresh counseling be held by including the petitioner herein in the selection process and thereafter, appointment letters be issued.

The respondents have not filed any counter-affidavit,

Patna High Court CWJC No.16684 of 2010 (3) dt.19-06-2018 2/2 hence this Court, after a lapse of eight years of filing of the present writ petition cannot be detained from passing orders in the present case.

Having regard to the facts and circumstances of the case, the District Magistrate, Gaya is directed to implement the directions contained in letter dated 17.11.2009, issued by the District Panchayati Raj Officer, Gaya, if such directions have either not already been carried out or in case, the said order passed by the District Panchayati Raj Officer, Gaya has not been annulled in appeal or set-aside by a competent court of law. The aforesaid exercise should be carried out within a period of four weeks from today.

With the aforesaid direction, the present writ petition is disposed of.
