JUSTICE NAVANITI PRASAD SINGH ORAL ORDER 04-03-2015 Petitioner no.1 is the father-in-law of the deceased, petitioner no.2 is the unmarried sister-in-law of the deceased and petitioner no.3 is the mother-in-law of the deceased. The informant is the father of the deceased and he alleges that for non-payment of dowry, his daughter has been killed by the three petitioners along with the husband Pawan Choudhary. Upon this information, Karpi (Sahar Telpa) P.S.Case No. 80 of 2014 was instituted under section 304B and 201 read with section 34 of the Indian Penal Code.
Learned counsel for the petitioners submits that the
Patna High Court Cr.Misc. No.35076 of 2014 (2) dt.04-03-2015 2 / 2 husband of the deceased has already surrendered and has been granted bail by the lower court itself.
In that view of the matter, I direct petitioner nos. 1 and 3, namely, Rajendra Chaudhary and Panpati Devi, to surrender in the court below and pray for regular bail, which shall be considered by the court below keeping in view the fact that the husband has already been granted bail.
So far as petitioner no.2, namely, Punam Devi, is concerned, she being unmarried young girl, in the event of arrest/ surrender within four weeks from today, she shall be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Jehanabad, in connection with Karpi(Sahar Telpa) P.S. Case No. 80/2014, subject to the conditions as laid down under section 438(2) Cr.P.C.
