JUSTICE MOHIT KUMAR SHAH ORAL ORDER 19-06-2018 The present writ petition has been filed for directing the respondents to consider the case of the petitioner for promotion on the post of Joint Secretary and Commissioner with effect from 26.06.2010 as well as to pay all the consequential benefits.

The petitioner has filed a supplementary affidavit wherein a notification dated 20.01.2011 has been annexed whereby and whereunder the petitioner has been granted

Patna High Court CWJC No.17019 of 2010(5) dt.19-06-2018 2/2 promotion on the post of Joint Secretary with effect from 29.06.2010, but in the said notification, it has been mentioned that the monetary benefit as a consequence of the said promotion shall be given from the date of joining on the said post.

In view of the aforesaid, the present writ petition, which was filed for grant of promotion to the post of Joint Secretary, has become infructuous since the petitioner has already been granted promotion. However, if the petitioner is aggrieved by non-grant of monetary benefits as a consequence of the said promotion, he may file a representation before the Respondent No. 2 i.e. the Secretary, Personnel and Administrative Reforms Department, Government of Bihar, Patna within a period of two weeks from today which shall be disposed of by the Respondent No. 2 by a reasoned and speaking order within a period of four weeks thereafter.
