The petitioner is accused in connection with Bhagalpur Rail P.S. Case No. 142 of 2016, registered under Section 38 of Bihar Excise (Amendment) Act, 2016. The accusation is of recovery of four bottles, each containing 375 ML India made foreign liquor from the bag of the petitioner at Platform No. 4 of Bhagalpur Railway Station. Learned counsel for the petitioner submits that petitioner has no criminal antecedent is in custody since 21.10.2016.
Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on
Patna High Court Cr.Misc. No.3433 of 2017 (2) dt.13-02-2017 2/2 bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Railway Judicial Magistrate at Bhagalpur in connection with Bhagalpur Rail Police Case No. 142 of 2016.
