JUSTICE RAKESH KUMAR ORAL ORDER 16-08-2016 Heard Sri Ramashish, learned counsel for the petitioner and learned Addl. Public Prosecutor. The sole petitioner, who is in custody since 26.05.2016 in connection with Bodh Gaya P.S. Case No.171 of 2016 registered for the offence under Section 47 of the Bihar Excise Amendment Act, 2016, has prayed for grant of bail. It was submitted by learned counsel for the petitioner that the petitioner was a passenger of three-wheeler, from which huge quantity of foreign liquor was recovered. Recovery was to the tune of 28 liters.

Learned Addl. Public Prosecutor has opposed the prayer for bail of the petitioner.

However, keeping in view the nature of accusation

Patna High Court Cr.Misc. No.31967 of 2016 (2) dt.16-08-2016 2/2 and period of custody, let the petitioner, namely, Tutu Kumar, be released on bail on furnishing bail bond of Rs.10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya in connection with Bodh Gaya P.S.
