This is a petition for grant of regular bail for offences under Sections 302, 328 and 201/34 of the Indian Penal Code.

Husband of the informant had accompanied Shankar Rai and Bhola Singh and, thereafter, he did not return, hence, suspicion is that murder was committed. Submission of the petitioners is that similarly situated co-accused, Birendra Ray, has already been allowed bail by a coordinate Bench of this Court in Cr. Misc. No. 53048 of 2016.

The learned counsel for the State does not dispute that allegation against the petitioners is similar to Birendra Ray.

Considering the aforesaid fact, the petitioners, above named, are directed to be released on bail on

Patna High Court Cr.Misc. No.4110 of 2017 (3) dt.01-03-2017 2/2 furnishing bail bonds of Rs.10,000/- (rupees ten thousand) each with two sureties of the like amount each in connection with Jagdishpur P.S. Case No. 11 of 2016 to the satisfaction of the Chief Judicial Magistrate, Bhojpur at Ara, or successor Court.
