The petitioner apprehends his arrest in connection with Gurua P.S. Case No. 42 of 2014 for the offences punishable under Section 376 of Indian Penal Code and 3/4 of the Dowry Prohibition Act.

The allegation against the petitioner is of sexually exploiting the informant for the last two years. Mr. S. Jamil Akhatar learned counsel for the petitioner with reference to the informatory petition placed at Annexure-2 submits that it is on account of fall out of marriage negotiations that the case in question has been instituted and that the petitioner apprehending such action had filed the informatory petition and his apprehensions were true since two months thereafter that the case in question had been instituted.

No.35992 of 2014 (2) dt.11-02-2015 2 / 2 Having heard learned counsel for the parties and taking note of the circumstances, let the petitioner namely, Gopal Kumar in the event of his arrest/surrender within four weeks from today, be released on bail upon furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, 1st Class, Sherghati, District-Gaya in connection with Gurua P.S. Case No. 42 of 2014 subject to the conditions stipulated under Section 438(2) of the Code of Criminal Procedure.
