Learned Counsel for the petitioner submits that the present writ petition has been filed for directing the respondent to confirm the petitioner on the post of Secretariat Assistant and extend all the services and monetary benefits and further to hold the petitioner as legally appointed assistant of Secretariat Cadre and consider his representation as contained in Annexure-4 in the light of order dated 31.07.2024 passed by this Hon'ble Court

Patna High Court CWJC No.13989 of 2024(2) dt.23-09-2024 2/3 in C.W.J.C. No.837 of 2016.

3. Learned Counsel further submits that the petitioner of present case and the petitioner of C.W.J.C. No.837 of 2016 were moved before this Hon'ble Court in which direction was made by this Hon'ble Court to file representation and their representation was rejected vide Memo No.16966 dated 10.12.2014. He further submits that one similarly situated person has moved before this Hon'ble Court in C.W.J.C. No.837 of 2016 which was allowed in his favour on 31.07.2024, and therefore, the petitioner has filed representation before the Additional Chief Secretary, General Administration Department, Government of Bihar, Patna to consider his case in the light of 4C of the Bihar State Litigation Policy, 2011 on 17.08.2024, but no decision has been taken by the respondent No.2 till date.

4. Learned Counsel further submits that a direction may be given to Respondent No.2 to take decision in the representation of the petitioner in the light of section 4C of the Bihar State Litigation Policy, 2011.

5. Learned Counsel for the State submits that the said representation is pending.

6. In this view of the matter, the present writ petition is hereby disposed off, directing the Respondent No.2 to take

Patna High Court CWJC No.13989 of 2024(2) dt.23-09-2024 3/3 decision on Annexure-4 of the writ petition, in the light of 4C of the Bihar State Litigation Policy, 2011, within 90 days from the date of production of this order.

7. With the aforesaid direction, the present writ application stands disposed off.
