JUSTICE SANJAY PRIYA ORAL ORDER 2/ 17-02-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The Petitioner seeks bail in Parihar P.S. Case No.102 of 2016 instituted for the offence under Section(s) 406, 409, 421 Indian Penal Code.

It has been submitted that the petitioner is ready to pay entire `7,47,020/- within nine months in equal installments. In view of such, let the Petitioner, above named, be released on provisional bail for a period of nine months to be calculated from the date of his release on furnishing bail bond of `10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Sitamarhi,

Patna High Court Cr.Misc. No.4985 of 2017 (2) dt.17-02-2017 2/2 in connection with Parihar P.S. Case No.102 of 2016, subject to the conditions that both the bailors shall be the close relative of the petitioner.

The petitioner after his release on provisional bail will deposit entire amount in nine equal installments and will produce 'No Dues Certificate' before the Court below from the authority concerned. If the petitioner produces 'No Dues Certificate' before the Court below, the Court below will confirm the provisional bail of the petitioner.

It is made clear that if the petitioner does not deposit the entire amount within a period of nine months, his provisional bail will be cancelled by the Court below.
