The petitioners apprehend their arrest in connection with Bakhri P.S. Case No.167 of 2022, registered for the offences punishable under Sections 302, 120(b) and 34 of the Indian Penal Code.
Allegation against the petitioners is of killing the father of the informant.
Learned counsel for the petitioners submits that the petitioners are innocent and have falsely been implicated in the present case. It is submitted that the petitioners have got no criminal antecedent as stated in paragraph-3 of the bail application. It is further submitted that the petitioners are made
Patna High Court CR. MISC. No.59459 of 2022(2) dt.03-01-2023 2/2 accused in the present case only on suspicion. There is no eye witness of the present occurrence. It is submitted that nothing has come against the petitioners during investigation. Learned APP for the State opposed the prayer for anticipatory bail of the petitioners by submitting that the witnesses have supported the prosecution case. Considering the nature of offence, I am not inclined to enlarge the petitioners on anticipatory bail. Accordingly, the prayer for anticipatory bail of the petitioners is rejected.
