JUSTICE VINOD KUMAR SINHA ORAL ORDER 19-09-2019 Petitioner seeks bail in anticipation of his arrest in connection with Muffasil P.S. Case No. 181 of 2019 registered for the offences punishable under Section 379 of the Indian Penal Code, 4/40 of Bihar Minor Mineral Concession Rule, 1972, Section 22 of MMDR Act, 1957 and Rules 3/8 of BMMC Rule, 2003, including Section 15 of ISEP Act, 1986. Prosecution case is that a truck loaded with sand met with an accident and loaded sand had fallen down in the canal and petitioner happens to be owner of the truck. Submission of learned counsel for the petitioner is that there is no seizure of sand and allegation is false and concocted and petitioner has falsely been implicated in this case and he has no criminal antecedent.

No.59393 of 2019(2) dt.19-09-2019 2/2 In view of above facts and circumstances, let petitioner, in the event of arrest or surrender, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Nawada, in connection with Muffasil P.S. Case No. 181 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioner shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned.
