JUSTICE SANJAY PRIYA ORAL ORDER 28-03-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Makhdumpur P.S. Case No. 258 of 2016 instituted for the offence under Sections 376/34 of the Indian Penal Code.
There is allegation against the petitioner in the written report that he committed rape with the informant. Case diary has been received.
The learned A.P.P. has submitted that all the witnesses have supported the case of the informant of committing rape with her by the petitioner. The statement of the victim girl under Section 164 Cr. P.C. has been recorded wherein she levelled specific allegation against the petitioner of committing rape with her.
