JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 24-12-2014 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Earlier while rejecting the prayer for bail of this petitioner this court directed the trial court to conclude the trial of the petitioner preferably within six months from the date of receipt/production of copy of order dated 05.02.2014 passed in Cr. Misc. No. 53106 of 2013 but the above stated order was received in the court of learned Ad hoc Additional Sessions Judge-I, Jehanabad on 07.08.2014 and admittedly, the case of the petitioner is still pending before the above stated court. However, it would appear from the show-cause filed on behalf of Superintendent of Police, Jehanabad that the prosecution case has already been closed.

Patna High Court Cr.Misc. No.35560 of 2014 (4) dt.24-12-2014 Therefore, in the aforesaid circumstance, this petition filed in connection with Sessions Trial No. 413 of 2012 arising out of Makhdumpur (Tehta) P.S. Case No. 389 of 2011 pending in the court of Ad hoc Additional Sessions Judge-I, Jehanabad is again rejected with direction to above stated court to conclude the trial of the petitioner within three months from the date of receipt/production of copy of this order.
