The petitioner is accused in connection with Gurua P.S. Case No. 152 of 2016, registered under Section 461, 379 of the Indian Penal Code.

The allegation of informant Santosh Paswan is that on 09.11.2016, in the evening, he went to his house after closing his shop and on the next day i.e. on 10.11.2016, when he came at his shop then found outer lock of the shop was broken, but inside lock was found intact. On verification, he came to know that some unknown thieves entered in his shop after breaking the roof of the shop and took away cash of Rs. 15,000 from the cash box. In that course a purse was found lying near his shop in which the Voter I.D. card of the petitioner was kept. The

Patna High Court Cr.Misc. No.4819 of 2017 (2) dt.01-03-2017 2/2 informant raised suspicion having hand of the petitioner in the occurrence of thieve of his grocery shop.

Learned counsel for the petitioner submits that, in fact, the purse of the petitioner was lost in the way, which is said to be found by the informant near his grocery shop on which basis informant has figured the name of petitioner in the present case. Further submission is that petitioner having no criminal antecedent is in custody since 10.11.2016.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, 1st Class, Sherghati at Gaya in connection with Gurua P.S.
