2. Petitioners apprehend arrest in a case registered for the offence punishable under Section 30a and other allied sections of the Bihar Prohibition and Excise Act.
3. Prosecution case is that 36 cartoons cough syrup was recovered from the vehicle.
4. Learned counsel appearing for the petitioners submits that the petitioners are innocent and have falsely been implicated in this case. Petitioners are neither owner nor driver of the vehicle in question. Petitioners claim clean antecedent.
5. Considering the facts of the case, this pre-arrest
Patna High Court CR. MISC. No.62284 of 2023(2) dt.11-10-2023 2/2 bail petition is allowed. In the event of arrest/surrender within six weeks from today, let all these petitioners, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Exclusive Special Judge, Excise, Court no.II, Muzaffarpur in Excise case no. 543 of 2023, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
