JUSTICE VINOD KUMAR SINHA ORAL ORDER 14-02-2017 This is an application for grant of bail for offences punishable under Sections 304B/34 of the Indian Penal Code. It has been submitted on behalf of the petitioner that earlier he had moved before this Court and his prayer for bail was rejected. However, he is in custody for about 4 years and up-tillnow only five witnesses have been examined in this case out of 11 witnesses.

Heard learned A.P.P. also.

Heard both sides. As per submission of the learned counsel for the petitioner, only five witnesses have been examined and the last witness was examined on 6.7.2013. As such, learned court below, i.e., learned Sessions Judge-III, Lakhisarai, is directed to expedite trial in connection with S.T. no. 702/14

Patna High Court Cr.Misc. No.4712 of 2017 (2) dt.14-02-2017 2/2 arising out of Chanan P.S. Case no. 47 of 2013 and take up this matter on day to day basis and try to conclude the same within a period of six months. The Superintendent of Police, Lakhisarai, is directed to produce the prosecution witnesses in the court below without fail. Learned District Judge, Lakhisarai, is also directed to monitor the case so as to get the case concluded within a period of six months.

With the aforesaid observation the present application stands dismissed.
