JUSTICE SANJAY PRIYA ORAL ORDER 27-02-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Vaishali P.S. Case No. 163 of 2016 instituted for the offence under sections 302, 201, 120-B of the Indian Penal Code.

It is submitted that besides the allegation of last seen, there is no allegation of overt act against this petitioner. C.D. has been received.

From the C.D. also, it appears that none of the witnesses has alleged any specific overt act against this petitioner. The only evidence is that the deceased had gone with the petitioner. Similar allegation has been levelled in the written report.

The petitioner is said to be in custody since 29.11.2016.

Patna High Court Cr.Misc. No.1194 of 2017 (3) dt.27-02-2017 Considering the aforesaid facts and circumstances of the case. Prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10, 000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur, in connection with Vaishali P.S.
