JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 20-02-2015 Heard learned counsel for the petitioners and the State. The petitioners apprehend their arrest in connection with Complaint Case No.282C of 2012 under section 498A of the Indian Penal Code.
Petitioner no.1 is husband of the Complainant. Petitioner nos.2 and 3, who are living separately, are brothers of husband of the Complainant.
Petitioner no.1 submits that he has filed Matrimonial Suit under section 9 of the Hindu Marriage Act but the Complainant is not willing to live with him. He further submits that the allegation is general and omnibus.
Patna High Court Cr.Misc. No.35767 of 2014 (2) dt.20-02-2015 Considering the facts and circumstances of the case, the petitioners namely, Hareram Poddar, Kundan Poddar and Bishundeo Poddar are directed to be released on anticipatory bail, in the event of their arrest/surrender, in connection with Complaint Case No.282C/2012, on furnishing bail bonds of Rs.5,000/- each with two sureties of the like amount each to the satisfaction of the S.D.J.M. Saharsa. The petitioners would cooperate in the trial and would not take unnecessary adjournments.
