ANJANA MISHRA ORAL ORDER 21-07-2015 Heard learned counsel for the petitioner and the learned counsel for the State.

The petitioner, being the husband of the complainant, is apprehending his arrest in connection with Complaint Case No.3137 of 2012 for allegedly having committed the offence under Sections 498A and 323 of the Indian Penal Code. Learned counsel for the petitioner submits that the marriage in question took place 20 years back and ever since she has been living together. It is further submitted that since she could not bear a child, the petitioner married with another lady with her consent and now on account of petty family disputes, the complainant has filed the present case. He further submits

Patna High Court Cr.Misc. No.27419 of 2015 (2) dt.21-07-2015 2/2 that the petitioner is willing and ready to keep the complainant with full dignity and honour and that there shall be no recurrence of any untoward occurrence so as to cause mental torture to her.

Considering the aforementioned submissions and the bona fide offer made by the petitioner, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of three weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri A.K. Dixit, learned Judicial Magistrate, 1st Class, Purnea, in connection with Complaint Case No.3137 of 2012, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
