The petitioner seeks release of his 4-wheeler i.e. Bolero Model of Mahindra & Mahindra, bearing Registration No. WB39A-7545, which was seized in connection with Case No. 232 C2 of 2019 registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Patna High Court CWJC No.18875 of 2019 dt.16-12-2019 2/2 In this case, counter affidavit has been filed on behalf of respondent no. 3, 4 and 5 and in paragraph - 7, it has specifically been mentioned that confiscation proceeding has already been initiated of the seized vehicle, vide Confiscation Case No. 45 of 2019 and vide memo no. 2019 dated 23-09-2019, notice has already been issued to the petitioner for appearance. Considering the fact that the confiscation proceeding has already been initiated in respect of the seized vehicle and notice to this effect has already been issued, the concerned District Collector is directed to conclude the same within 60 days from the date of receipt/production of a copy of this order. Writ petition stands disposed of with the aforesaid direction.
