====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER --------------- 15-02-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks bail in connection with Dhanarua P.S. Case No.329 of 2016 registered under Sections 341, 323, 324, 326, 307, 302 and 120(B) of the Indian Penal Code besides Section 27 of the Arms Act.

The accusation is that seven persons, named in the F.I.R., including the petitioner reached near the father of the informant and started to hot exchange of words with the father of the informant on the point of grazing the she-buffalo at their field. At that time, the co-accused Sachit Singh started to cause assault to the father of the informant through lathi. In the meantime,

No.3850 of 2017 (2) dt.15-02-2017 2/3 Sanjeev Kumar alias Bhaijee and Rajeev Singh also came there and started to cause assault to the father of the informant through lathi and danda. In that course, the co-accused Vijay Singh shot fire through his pistol at the father of the informant causing firearm injury on his stomach. On hearing the sound of firing, when the sister of the informant came there then this petitioner caused injury on her head through Farsa.

Learned counsel appearing on behalf of the petitioner submits that the petitioner is not the assailant of the deceased, the father of the informant, rather there is specific allegation against the co-accused Vijay Singh to shot fire at the father of the informant through pistol. The only allegation against the petitioner is to cause injury at the head of the sister of the informant through Farsa. Moreover, the four injuries, as found on the person of the deceased, the father of the informant, are said to be caused by firearm. The petitioner having no criminal antecedent is in custody since 22.07.2016.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Sub Divisional Judicial Magistrate, Masaurhi, Patna, in connection
