The petitioner is languishing in custody in a case registered for the offences punishable under Section 392 of the Indian Penal Code.

It is alleged that when the informant was going by motorcycle, he was robbed by three unknown miscreants riding on motorcycle and snatched mobile, ATM, PAN card and other articles.

It is submitted by learned counsel for the petitioner that petitioner is innocent and he has falsely been implicated in this case. The F.I.R has been lodged

Patna High Court CR. MISC. No.58997 of 2022(3) dt.04-02-2023 2/2 against unknown. The petitioner was not apprehended from the spot. Nothing has been recovered from the conscious possession of the petitioner. The petitioner has still not been put on T.I.P. The petitioner is languishing in custody since 06.07.2022. A statement has been made in para 3 of the petition that petitioner is accused in one other case apart from the present one. In the facts and circumstance of the case, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Sarai P.S. Case No. 239 of 2018, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
